Barely a month since Kiambu Governor was impeached by the County assembly of Kiambu he has been met with a rude sock of Senate impeachment. Waitutu is popularly known as Baba Yao was finally impeached by Senate.
The Senators on Wednesday upheld Waititu’s impeachment, following three charges.
The first charge was a gross violation of the Constitution, the Public Finance Management Act, and the PPD Act. For this charge, 27 senators upheld the charge, while 12 voted in the governor’s favor.
In the second charge – crimes under the national law, 28 senators upheld the charge, while 11 voted to drop the charge.
In the third charge – abuse of office – 28 voted to uphold the charge, while 11 voted to drop it.
The motion is believed to have had all the hallmarks of President Uhuru Kenyatta and Deputy President William Ruto duel. The Senators supporting deputy president William Ruto are believed to have voted to keep Waitutu as the Governor while those supporting handshakes are believed to have voted for the ouster of Waititu as a Kiambu Governor.
There was a total of 38 senators in the House on Wednesday. Some 28 senators, most of them from opposition coalition Nasa, convicted the governor on all three counts leveled against him by the county assembly and voted to remove him from office.
The Speaker of Senate had gazetted the impeachment of Kiambu Governor Waitutu at the close of the session.
Waititu becomes the second governor to be impeached by Senate since the promulgation of the new constitution in 2010.
By the close of Thursday Waitutu had gone to the Supreme court to challenge the Senate and County assembly impeachment. It was decided that his case is of urgency and its expected to start being listened by inter partes on Monday. This continues to be the problems aligning to Waitutu who was seen supporting the Deputy President.
According to the Kenyan Constitution, the deputy is supposed to take over the position of Governor in Kiambu County for the remaining time.
